These are the trading terms and conditions of Kemp Agencies These terms and conditions together with our privacy policy apply to all our customers, registered and un-registered online users. By making a purchase, placing an order or registering on our website you agree and give your consent to these terms and conditions and our privacy policy.
You understand and agree that the owners of this site shall not be liable for any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, data or other intangible losses (even if the owners of this site have been advised of the possibility of such damages), resulting from the use or the inability to use the product(s) and or service(s) or any misuse of the product(s) and or service(s) in a manner not in accordance with their intended use.
Products and Orders
Product Descriptions: We make every effort to ensure product descriptions and other content on the site are accurate. However, we do not guarantee that any information is complete, accurate or free from errors.
Product Images: Product images are for illustrative purposes only. While we make every effort to ensure accuracy, there may be occasional discrepancies.
Order Acceptance: Your order is subject to our acceptance. We reserve the right to refuse or cancel any order for reasons including, but limited to, product availability, shipping location, errors in product information, or suspected fraud.
Sale Products: Sale products are non-returnable and non-refundable, unless the product is faulty.
Pricing: Prices are subject to change without notice. While we make every effort to ensure accuracy, errors may occur.
GST: We are required to automatically charge and withhold the applicable GST for orders to be delivered to addresses within Australia. Each customer shall be solely resposible for all sales taxes.
Order-In Products
Order-in products are non-stocked items that we are happy to source upon request.
Please note the following conditions:
- A minimum order quantity applies.
- A quote will be issued outlining the minimum order quantity and cost. This quote must be agreed to, signed, and returned before the product(s) can be ordered.
- Full payment is required prior to your special order being placed.
- Please allow a minimum of 4 to 6 weeks, depending on availability of product(s).
- All order-in products are non-returnable and non-refundable, except in cases where the product is faulty. (Faults will be assessed at the discretion of Kemp Agencies)
Payment Methods
We accept Visa and Mastercard for all payments. There are no additional fees for credit card transactions. All payments are processed securely through a trusted payment gateway to ensure your personal and financial information remains private and protected.
Trading Account Customers
Payments are to be made by the 20th day of the month following the invoice date. Interest may be charged on overdue accounts. Kemp Agencies reserves the right to withdraw credit facilities without notice at its discretion. Any costs incurred to recover outstanding amounts will be the responsibilty of the customer.
Returns Policy
Condition for Returns: All returns must be in their original, unopened packaging and in re-sellable condition. Opened goods are not eligible for return due to health and safety regulations, except for faulty or incorrectly delivered products.
Change Of Mind Returns: Must be made within 7 days from date of invoice. A 10% restocking fee may apply. Return shipping/courier costs are at the customer’s responsibility. A $5.00 collection fee may apply for customers within our delivery service area.
Damaged or Faulty Product/s: if the product/s are damaged or faulty, no fees will apply. Kemp Agencies will replace, credit or refund these products within 14 days of the invoice date.
Incorrect or Substitute Product: If the product/s are incorrectly packed or the substitute product is unsuitable, no fees will apply. Kemp Agencies will replace, credit or refund these products within 14 days of the invoice date.
Return Approval: All returns require prior approval from Kemp Agencies. Please contact us to discuss returns. If approved Kemp Agencies will supply a Stock Return Authorization (SRA) form. Returns without the completed form will not be collected or processed.
Final Discretion: All returns, credits, and refunds are at the sole discretion of Kemp Agencies.
